Legal note

This is the legal documentation for the Rytmify website and the Rytmify iPhone app while the product is in beta. It is the document we publish for Swiss law (seat: Bern) and for Apple App Store review.

Last updated: 14 August 2026. This note describes how Rytmify is run. It is not legal advice to you, and it is not a substitute for a Swiss attorney. Supervisory authority for data protection in Switzerland: the Federal Data Protection and Information Commissioner (FDPIC).

1. Imprint

Required identification of the operator for a commercial offer from Switzerland (Unfair Competition Act, UWG; seat in the Canton of Bern). The figures below are those published by the Commercial Register Office of the Canton of Bern in the Swiss Official Gazette of Commerce (SHAB) on 29 July 2026, and those listed on portanx.com.

Rytmify is a native iPhone application for independent music on Audius and live radio, with an optional Premium subscription for software features. The website presents the product. The app is in beta until it is live on the App Store.

2. Privacy

This section is the privacy policy for the beta, under the Swiss Federal Act on Data Protection (FADP) and, where it applies, the GDPR. The data controller is PortanX – Catalin Portan, Flurstrasse 24, 3014 Bern, Switzerland, UID CHE-373.501.736.

2.1 Age (16+)

Rytmify is for people aged 16 and over. We do not knowingly collect personal data from children under 16. If you believe a minor has used the app with an account, write to support@rytmify.com and we will delete what we can.

2.2 What we collect

  • Account (optional): email and sign-in credentials through Google Firebase Authentication. We do not store plain-text passwords.
  • Cloud library (if signed in): favorites and playlists in Firebase Firestore, tied to your account UID.
  • Purchases: Premium is sold by Apple. We receive entitlement status (whether Premium is active). We do not receive your card number.
  • In-app guide: if you ask the guide a question, the prompt and the UI language go through a Cloudflare Worker to produce a help reply. We do not send your email or Firebase UID to the model provider.
  • On the phone: playback preferences, skip counts, trial start, and the local library stay in app-private storage.
  • Website: this site is hosted on Cloudflare Pages. We do not run advertising cookies or analytics pixels on rytmify.com. Cloudflare may process technical logs (for example IP address) to deliver the pages and to protect the host.

2.3 Music and radio third parties

  • Audius: metadata and audio come from Audius discovery nodes, requested with app_name=Rytmify. Those nodes process your IP address to deliver the stream. Share opens the original Audius permalink.
  • Radio Browser and broadcasters: station search uses radio-browser.info. When you play a station, the stream host may process your IP address. Rytmify does not operate those stations.

2.4 Why we process data

We process data to run the app (sign-in, library sync, Premium unlock), to answer support and guide questions, to host the website, and to meet Swiss and Apple rules (including account deletion). We do not sell personal data. We do not use it to build an advertising profile.

2.5 Retention and transfers

Account data is kept while the account is active, then deleted when you delete the account or when you ask us to erase it, unless a short legal retention is required. Processors may handle data in Switzerland, the EEA, and the United States (Apple, Google Firebase, Cloudflare, Audius node operators). Where FADP or GDPR requires it, we rely on contracts and the safeguards those providers publish.

2.6 Your rights

Under the FADP you may request access, rectification, erasure, and information about our processing, and you may object in the cases the Act allows. Where GDPR applies, you also have portability, restriction, and the right to lodge a complaint with a supervisory authority. Delete the account in Rytmify Settings while signed in, or email support@rytmify.com. Apple requires a way to delete an account; that is it.

3. Terms of use

By using the Rytmify app or website you agree to this Legal note, including the privacy section. If you do not agree, do not use the service.

3.1 The service

Rytmify is a native iOS listening app. It lets you hear independent music through the Audius protocol and live radio from third-party directories. We do not operate Audius, Radio Browser, or the radio stations. The website is a presentation of the product. The app is offered as beta software: features may change, and streams may fail when a third party is down.

3.2 Age and accounts

You must be at least 16. An account is optional. You are responsible for activity under your credentials. You may delete the account in Settings.

3.3 Audius

Track metadata and streams come from Audius discovery nodes. Share sends the artist’s Audius page — title, name, original link — not a copy of the file. Offline files, when the feature is on, are a personal copy of what you streamed. They are not a licence to redistribute. See the Audius Terms of Use.

3.4 Radio

Live stations come from Radio Browser and from each broadcaster. Availability, quality, and regional rights are outside our control. Do not record or rebroadcast a stream except as the law and the broadcaster allow.

3.5 In-app guide

The guide answers questions about Rytmify. Replies may be incomplete. They are not legal, medical, or financial advice, and they do not speak for an artist.

3.6 Acceptable use

Do not misuse the service, scrape at abusive volume, or interfere with other people. We may suspend access if these terms are broken.

4. Premium and Apple subscriptions

This section is written for Apple App Store Guideline 3.1.2 (auto-renewing subscriptions).

Rytmify is free to download. Rytmify Premium is an optional auto-renewing in-app subscription sold by Apple, not by PortanX directly. Lengths offered: monthly, quarterly, and yearly. The price, the currency, and the exact title Apple shows are those of your App Store storefront; Apple displays them before you pay. Payment is charged to your Apple ID. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Apple will charge the renewal within 24 hours before the period ends.

Manage or cancel: iPhone Settings → your name → Subscriptions, or apps.apple.com/account/subscriptions. Refunds follow Apple’s rules. PortanX cannot cancel an Apple subscription for you and does not take your card.

Premium unlocks Rytmify software features (for example extra skips, station choice after a free trial, sleep timer, offline listening). You are not buying the Audius catalog. Audius-sourced audio remains available under the licences Audius and the artist use.

Privacy for purchases is in section 2. These terms are in section 3.

5. Notices

  • Beta. The app and this Legal note are published as beta until App Store release.
  • 16+. The product is not directed at children.
  • No sale of the catalog. Rytmify does not sell Audius tracks. Share does not send the audio file.
  • Live radio is not a playlist. A station is live, or it is not there.
  • Support URL for Apple: rytmify.com/help and support@rytmify.com.

6. Governing law

These terms and the operation of Rytmify are governed by the substantive laws of Switzerland. The operator’s seat is Bern. Subject to mandatory consumer protections that apply in your country, the courts of the Canton of Bern have jurisdiction.
